Terms of Service
Welcome to Rapid VPN, a service provided by DuoPeak, Inc. (“RapidVPN”, "DuoPeak", "we" or "us"). This page explains the terms by which you may use our online and/or mobile services, website, games, and software provided on or in connection with the service (collectively the "Service"). By installing, accessing, or using the Service, or by checking a box or clicking a button signifying your assent to these terms, you signify that you have read, understood, and agree to be bound by this Terms of Use Agreement ("Agreement") and to the collection and use of your information as set forth in the Rapid VPN Privacy Policy https://rapidvpn.app/ios_privacy, whether or not you are a registered user of our Service.
We reserve the right to modify these terms and will provide notice of these changes as described below. This Agreement applies to all visitors, users, and others who access the Service ("Users"). Please read this Agreement carefully to ensure that you understand each provision.

1. License
1.1 You acknowledge that you have only a non-exclusive and limited right to use our products and services for non-commercial purposes only within the validity period of the agreement. You may make a single copy of the Product for archival or backup purposes. You must include all Notices on all copies of the Product. You may not reverse engineer, decompile, or disassemble the Product or attempt to gain access to the source code for the Product, except and only to the extent that it is expressly permitted by applicable law, and to the extent applicable law permits contractual waiver of such right, you hereby waive your rights to do so.
1.2 You will not transfer or assign the Product or this Terms of Service, or any rights or obligations hereunder without the prior written consent of Rapid VPN or DuoPeak, Inc.
1.3 Your rights under these Terms will automatically terminate if you breach any of your material obligations under this Terms of Service agreement. Upon any termination of Terms, you will destroy all copies of the Product promptly after such termination.
1.4 All rights not expressly granted are reserved.
2. Infringement Indemnity
Neither Rapid VPN, nor its affiliates, subsidiaries nor the Licensors will have any liability for any claim based upon or arising out of (1) Intentional or negligent acts of anyone other than the provider of Product; or (2) the combination, operation or use of the Products with any equipment, devices or software not supplied by Rapid VPN, or (3) the alteration or modification of Product.
To the full extent permitted by law, this section states the entire liability of Rapid VPN, its affiliates, subsidiaries and the Licensors and your sole remedy with respect to any claim of infringement.
3. Limited Warranty
The Service is provided on an "as is" and "as available" basis. Use of the Service is at your own risk. To the maximum extent permitted by applicable law, the Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Especially in the following cases:
(a) modification or alteration of the Products made without the prior written approval of Rapid VPN,
(b) accident, neglect, misuse or abuse, or
(c) exposure to conditions outside the range of the environmental, power and operating specifications provided by Rapid VPN.
4. Disclaimer and Limitation of Liability
Except as expressly set forth in these Terms of Service, neither Rapid VPN, its affiliates, subsidiaries nor the Licensors make any other warranties, express or implied, including any implied warranties of merchantability and fitness for a particular purpose.
Rapid VPN, its affiliates, subsidiaries and the Licensors expressly disclaim all warranties not stated in this Terms of Service agreement. Any implied warranties that may be imposed by law are limited to the terms contained in this TOS to the Rapid VPN extent permitted by law.
5. User Judgment
Some features of Rapid VPN will cause some programs, functions or files be stopped, removed or uninstalled.
Before using Rapid VPN, you should carefully read the instructions and tips and judge whether the product meet your purposes, needs, and safety requirements. Once you install the product and / or make any operation, you commit yourself to bear the relevant responsibilities.
We provide a privacy policy that as an important part of this agreement, you should read this policy and agree to its contents before installing and running the product.
6. Copyright Policy
Any end user should not use Rapid VPN for infringement on the intellectual property rights of others, (including without limitation to patent, trademark, trade secret, copyright, and other proprietary rights), and if you, the copyright owner or an authorised representative, believe that any content infringes on your copyrights, you may submit a notification pursuant to the Digital Millennium Copyright Act (“DMCA”) by providing us with the information as follows:
- A physical or electronic signature of a person authorized to act on behalf of the owner or an agent of an exclusive right that is allegedly infringed;
- Identification of the copyright claimed to have been infringed;
- Identification of the material that is claimed to be infringing, and where it is located in the App;
- Information reasonably sufficient to permit the service provider to contact you;
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law, and;
- A statement, made under penalty of perjury, that the above information is accurate, and that you are the copyright owner or are authorized to act on behalf of the owner.
We respect the intellectual property rights of others and will respond to clear notices of alleged infringement. You acknowledge that if you fail to comply with all of the requirements of this section, your notice may not be valid.
7. General Terms and Conditions
7.1 This Terms of Service agreement constitutes the entire agreement between you and Rapid VPN with respect to the subject matter hereof and supersedes all previous and contemporaneous written and oral representations, proposals, negotiations and communications, including, without limitation, the terms and conditions of any purchase order.
7.2 Rapid VPN may assign this TOS or any of the rights or obligations hereunder, and any causes of action arising hereunder, to any third party without necessity or obligation of notice to you. The waiver or failure of either party to exercise in any respect any right provided for herein will not be deemed a waiver of any further right hereunder. The invalidity or unenforceability of any provision of this Terms of Service agreement will not affect the validity or enforceability of any other provision, the remaining provisions being deemed to continue in full force and effect.
7.3 Rapid VPN will not be responsible for any failure to perform its obligations under this Terms of Service agreement due to circumstances beyond its reasonable control, including without limitation acts of God, war, riot, terrorism, embargoes, acts of civil or military authorities, fire, flood or accidents. You agree that Rapid VPN will be entitled to all legal and equitable remedies otherwise available to it to protect the intellectual property, proprietary rights and Confidential Information of itself and its Licensors, including, without limitation, the right to seek and obtain injunctive relief and enforce the same against you without the necessity of having to post bond or other such guarantee.
8. Paid Services
8.1 In-Service Purchases.
In certain areas of the Service, you may purchase with "real world" currency a limited, personal, non-transferable, non-sublicensable, revocable license to use: (a) "virtual currency" including, but not limited to virtual cash or gems; (b) certain types of DuoPeak Property; and (c) certain other goods or services ("Merchandise"). We may manage, regulate, control, modify, or eliminate services at any time, with or without notice, and shall have no liability to you or any third party if we exercise any such rights.
8.2 No Refunds.
You may cancel your Rapid VPN subscription at any time; however, there are no refunds for cancellation. In the event that Rapid VPN suspends or terminates your account or this Agreement, you understand and agree that you shall receive no refund or exchange for any unused time on a subscription, any license or subscription fees for any portion of the Service, any content or data associated with your account, or for anything else. Further, all purchases of Rapid VPN products and services are non-refundable, and Rapid VPN shall not be required to provide a refund for any reason.
9. Privacy
We care about the privacy of our Users. You understand that by using the Services you consent to the collection, use and disclosure of your personally identifiable information and aggregate data as set forth in our Privacy Policy https://rapidvpn.app/ios_privacy, and to have your personally identifiable information collected, used, transferred to and processed in the United States.
10. Security
We care about the integrity and security of your personal information. However, we cannot guarantee that unauthorized third parties will never be able to defeat our security measures or use your personal information for improper purposes. You acknowledge that you provide your personal information at your own risk.
11. Third-Party Links and Information
The Service may contain links to third-party materials that are not owned or controlled by Rapid VPN or DuoPeak. Neither Rapid VPN nor Duopeak endorse or assume any responsibility for any such third-party sites, information, materials, products, or services. If you access a third-party website or service from the Service or share your User Content on or through any third-party website or service, you do so at your own risk, and you understand that this Agreement and our Privacy Policy do not apply to your use of such sites.
DuoPeak does not warrant, endorse, guarantee, or assume responsibility for any product or service advertised or offered by a third party through the Service or any hyperlinked website or service, and DuoPeak will not be a party to or in any way monitor any transaction between you and third-party providers of products or services.
You expressly relieve Rapid VPN and DuoPeak from any and all liability arising from your use of any third-party website, service, or content, including without limitation User Content submitted by other Users. Additionally, your dealings with or participation in promotions of advertisers found on the Service, including payment and delivery of goods, and any other terms (such as warranties) are solely between you and such advertisers. You agree that Rapid VPN and DuoPeak shall not be responsible for any loss or damage of any sort relating to your dealings with such advertisers.
12. Applicable Law and Disputes
12.1 For any dispute you have with Rapid VPN, you agree to first contact us and attempt to resolve the dispute with us informally. We each agree to resolve any dispute arising out of, in connection with, or relating to this Agreement under Google Play’s policies.
12.2 This Terms of Service agreement will, in all respects, be governed by and enforced in accordance with the laws of California (without giving effect to any choice or conflict of laws). The United Nations Convention on Contracts for the International Sale of Goods will not apply to this Agreement. You consent to the jurisdiction of competent courts in California for the resolution of any dispute arising under or related to this Terms of Service agreement or the Products.
